Terms of Service

Effective Date: December 4, 2024

Agreement to Terms

By using the services of EZ-Carry University Place Towing, you agree to these Terms of Service. If you don't agree with any part of these terms, please do not use our services. We reserve the right to update these terms at any time, and your continued use of our services means you accept any changes.

Services We Provide

We offer towing and roadside assistance services in University Place, WA and surrounding areas. Our services include emergency towing, flatbed towing, roadside assistance, accident recovery, and more. Service availability may vary based on location, weather conditions, and other factors beyond our control.

We'll always do our best to help you quickly and safely, but we can't guarantee specific arrival times. Traffic, weather, and the number of calls we're handling can affect how fast we get to you.

Payment and Pricing

You agree to pay for all services provided at the rates communicated to you before service begins. Payment is due at the time of service unless other arrangements have been made. We accept cash, credit cards, and debit cards. Prices may vary based on distance, vehicle type, time of day, and service complexity.

If your vehicle is stored at our facility, storage fees will apply after the first 24 hours. You'll be notified of these fees when your vehicle is brought to our location.

Your Responsibilities

When you call for our services, you agree to:

  • Provide accurate information about your location and vehicle
  • Have proper identification and proof of vehicle ownership
  • Remove all personal belongings from your vehicle before it's towed (we're not responsible for items left inside)
  • Inform us of any special conditions with your vehicle (like modified suspensions or low clearance)
  • Be available to receive calls from our dispatch team

Liability and Vehicle Condition

We take great care with every vehicle we handle. However, you understand that towing involves some inherent risks, especially if your vehicle has pre-existing damage or mechanical issues. We're not responsible for damage that results from your vehicle's pre-existing condition.

Before we tow your vehicle, our driver will inspect it and note any existing damage. You'll have a chance to review this inspection. Any claims for damage must be reported within 24 hours of service.

We carry appropriate insurance as required by law. Our liability is limited to the actual cash value of your vehicle or the cost to repair damage we caused, whichever is less.

Cancellations

If you need to cancel your service request, please call us as soon as possible. If our driver has already been dispatched and is on the way to your location, a cancellation fee may apply to cover the time and fuel spent responding to your call.

Storage and Liens

If your vehicle is stored at our facility and you don't pay for services or pick up your vehicle, we have the right to place a lien on your vehicle according to Washington state law. This means we can keep your vehicle until payment is made. After a certain period, we may be able to sell the vehicle to recover our costs.

Limitation of Liability

To the fullest extent permitted by law, EZ-Carry University Place Towing is not liable for any indirect, incidental, or consequential damages arising from our services. This includes things like lost wages, rental car costs, or other expenses beyond the direct cost of our service.

Dispute Resolution

If you have a problem with our service, please contact us first so we can try to resolve it. Most issues can be worked out through honest conversation. If we can't reach an agreement, any disputes will be resolved according to the laws of Washington state.
